General Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from Marion Duschletta (hereinafter referred to as "Marion Duschletta") to consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.


2. Contracting Party

The purchase contract is concluded with Marion Duschletta, Owner: Marion Duschletta, Schartis 1669, 3457 Wasen im Emmental, Switzerland, Company Identification Number (UID): CHE-152.975.116.

 

3. Conclusion of the Contract

3.1. The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order.

3.2. By clicking the [Buy Now] button, you submit a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

 

4. Right of Withdrawal

4.1. If you are a consumer (i.e., a natural person who places the order for purposes that cannot predominantly be attributed to their commercial or self-employed professional activity), you are entitled to a statutory right of withdrawal.

4.2. If you, as a consumer, exercise your right of withdrawal under section 4.1, you are responsible for bearing the regular costs of the return.

4.3. The details of the right of withdrawal are governed by the rules set out in our Return and Cancellation Policy.

 

5. Prices and Shipping Costs

5.1. The prices listed on the product pages include statutory VAT and other price components.

5.2. In addition to the stated prices, we charge shipping costs for delivery, which will be disclosed on the product pages, in the shopping cart system, and during checkout.

 

6. Delivery

Delivery is carried out in accordance with our shipping terms, which are specified on our website.

 

7. Payment

Payment is made in accordance with the payment method selected during checkout.

 

8. Retention of Title

The goods remain our property until full payment has been received.

 

9. Warranty for Defects

Marion Duschletta is liable for defects in accordance with the applicable statutory provisions, particularly §§ 434 et seq. of the German Civil Code (Bürgerliches Gesetzbuch, BGB).

 

10. Dispute Resolution

The EU Commission has created an internet platform for the online resolution of disputes. This platform serves as a point of contact for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase agreements. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
